1. Eligibility
The Platform and the services offered through it (“Services”) are intended for Users who can form legally binding contracts. By using the Platform/Services, you represent and warrant that:
• You are at least 18 years of age and not disqualified from contracting; if a minor uses the Platform, such access and any transaction must be with the consent and under the supervision of a parent/guardian and as per applicable law;
• You are accessing the Platform of your free will; and
• Your use complies with applicable laws and regulations.
2. Your Use of the Platform and Services
• By merely accessing or using the Platform, you agree—without limitation—to be bound by these Terms and all policies referenced herein (collectively, the “Policies”), whether you have read them or not.
• You agree to use the Platform and Services only for lawful purposes, and to comply with all applicable laws and regulations. You must not take any action that compromises the security, availability, or integrity of the Platform/Services, or that harms other Users.
• You agree to provide true, accurate, current, and complete information whenever requested. The Company may verify such information and, if found false or misleading (in whole or part), may refuse registration, suspend access, or debar you from the Platform and/or services provided by the Company or by authorised third-party service providers (“Authorised Third Party Service Providers”).
• You agree not to add to, delete from, or otherwise modify the Platform or attempt to access any Services in a manner that infringes third-party rights. The Company may monitor usage to ensure compliance.
• If a delivery fails due to an error by you (incorrect name, address, contact details, or other information), you agree to bear re-delivery costs.
• Use of the Platform for unauthorised commercial purposes is prohibited. Unauthorised advertisements, affiliate links, or solicitations may be removed and may lead to account termination.
• You agree to exercise prudent judgment before entering any transaction via the Platform and/or via any Authorised Third Party Service Provider.
3. Privacy Practices
We value your privacy. Please refer to our Privacy Policy, which also governs your visit to the Platform. Your continued use of the Platform signifies that you have read and accepted the Privacy Policy and consent to the use of your information in accordance with it.
4. Your Account
• This Platform is intended for adults. Any minor using the Platform is presumed to do so under guardian supervision.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. The Company shall not be liable for losses arising from your failure to safeguard credentials.
• You agree to provide accurate Registration Data and to keep it updated. If information is untrue, inaccurate, incomplete, or not current—or reasonably suspected as such—the Company may suspend or terminate your access.
• If you suspect unauthorised access or a security breach, notify us immediately at [support@cocoandco.in]. We may require a password reset and/or temporarily block or suspend your account.
• If you use the Platform on behalf of another person/entity, you confirm you are authorised to bind them to these Terms; if they refuse, you accept liability for any misuse.
• The Company may refuse service and/or terminate accounts without prior notice for breach of these Terms or to protect the Company’s interests.
5. User Content
We may allow you to upload or submit content (e.g., images, reviews, comments, artwork) (“Content”).
• You are solely responsible for your Content. The Company does not endorse and has no control over such Content and makes no warranties regarding accuracy, integrity, or reliability.
• You acknowledge that Content is not confidential and you have no expectation of privacy in it.
• By providing Content, you grant the Company a worldwide, perpetual, irrevocable, transferable, royalty-free licence (with the right to sublicense) to use, reproduce, adapt, modify, publish, translate, create derivative works from, distribute, publicly perform and display such Content on the Platform, our social channels, and in marketing materials, and you waive any moral rights to the extent permitted by law.
• Report objectionable Content at [support@cocoandco.in]. The Company may, at its discretion, remove or decline to remove Content.
• The Company is not obligated to monitor Content; however, it may act on violations of these Terms or applicable law.
6. Product Information
We endeavour to present product details accurately. However:
• Descriptions, colours, and other content may include typographical errors or inaccuracies, or may be outdated. Images are indicative and may differ from the actual product, including due to screen settings and the nature of fabrics.
• The Company may, at any time and without notice (including after an order is placed), correct or update information, including price and availability. If a correction affects your order, we will notify you and proceed as per applicable law (including cancellation/refund where relevant).
• For bundled offers (e.g., Buy 2 Get 1), all items forming part of the offer must be returned together for a refund/exchange.
7. Title to Products
Until full payment is received and the order is shipped, title in the goods remains with the Company. Upon delivery to you, title and risk of loss pass to you. Handle products carefully if you intend to return them.
8. Third-Party Links and Resources
The Platform may link to third-party websites or display third-party content/advertisements. The Company does not control and is not responsible for such sites or their content, privacy policies, or practices, and does not endorse them. Your use of third-party resources is subject to their terms, and you are advised to review those terms and privacy policies.
9. User Conduct (Prohibited Activities)
You shall not host, display, upload, modify, publish, transmit, update, or share any information or Content that:
• belongs to another person without rights;
• is illegal, harmful, defamatory, obscene, pornographic, paedophilic, invasive of privacy, hateful, ethnically or racially objectionable, or otherwise unlawful;
• harms minors;
• infringes the intellectual property of the Company or any third party;
• violates any law in force;
• misleads about the origin of messages or is grossly offensive/menacing;
• harasses, abuses, stalks, threatens, or otherwise violates legal rights of others;
• impersonates another person;
• contains malware/viruses or code designed to interrupt or limit functionality;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order;
• engages in fraudulent or illegal activity, including attempts to obtain passwords or private information;
• reverse-engineers, decompiles, disassembles, copies, reproduces, sells, modifies, transmits, publishes, or creates derivative works from the Platform/Services for commercial purposes without written consent;
• stores/displays/publishes adult or offensive content as determined by the Company;
• attempts unauthorised access to Company servers/services or engages in network abuse;
• interferes with other Users’ access to the Platform/Services.
The Company may take appropriate action—including suspension/termination—where misuse is suspected. You agree to be responsible for consequences of your actions and to indemnify the Company for losses arising from your misuse (see Clause 20).
10. Transactions and Payments
• The Company may stipulate a minimum order value.
• You must use only payment instruments lawfully owned by you. The Company may involve third parties to process payments.
• The Company is not liable for declines due to lack of authorisation, bank limits, network issues, or any payment failures. If fraudulent activity is detected, the Company may cancel orders, recover dues, and pursue legal remedies.
Pricing: Prices are in INR. Prices and availability are subject to change without notice. The Company may contact you for instructions or cancel orders in case of pricing or information errors.
11. Shipping & Delivery
• Deliveries are effected via Company or its logistics partners across serviceable pin codes. Estimated timelines are shown at checkout; typical range is 2–5 working days (metros) and 3–7 working days (non-metros); remote locations may take longer.
• You must provide a complete and accurate shipping address and contact details. Non-delivery arising from incomplete/incorrect details will be at your risk.
• Up to three delivery attempts may be made; persistent unavailability may lead to cancellation.
• Delays may occur due to factors beyond our control (logistics disruptions, weather, strikes, force majeure). The Company will make reasonable efforts to inform you of material delays but is not liable for consequential losses.
• Shipping fee may be charged below a specified cart value; such fees (if any) are displayed at checkout.
12. Returns, Exchanges & Alterations
• Return/Exchange window: within 4 days of delivery; items must be unused, unwashed, with all tags and original packaging intact. Certain categories may be non-returnable as specified on the product page.
• Return charges: If pickup is arranged by us, a flat ₹99 fee applies. Alternatively, you may self-ship; our warehouse address will be provided by email once your request is raised.
• Refunds: processed after quality check at our facility, to the original payment method or as store credit (as applicable).
• Exchanges: subject to stock availability.
• Alterations: The Company offers minor alterations for a nominal charge. Please email [support@cocoandco.in] with your order number, garment details, and requested change; we will confirm feasibility, charges, and timelines.
• Offer/bundle orders: For offers such as “Buy X Get Y”, all items forming part of the offer must be returned together.

13. Intellectual Property
• All rights, title, and interest in and to the Platform/Services—including domain name www.cocoandco.in, trademarks, logos, images, designs, graphics, text, software, code, and other content—belong to the Company or its licensors.
• No proprietary rights are granted to you except the limited right to access and use the Platform in accordance with these Terms.
• You may not copy, imitate, reproduce, distribute, sell, display, or use any intellectual property without prior written consent of the Company or the relevant owner.
User Licence: Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Platform for personal, non-commercial purposes.
14. Advertisements
The Company may display advertisements and publicity materials (including third-party ads) on the Platform. Placement and content of such materials are at the Company’s discretion.
15. Electronic Communications
When you access the Platform, place orders, or communicate with us, you consent to receive communications electronically (email/SMS/WhatsApp/in-Platform notices).
16. Disclaimer of Warranties
Your use of the Platform/Services is at your sole risk. The Platform, Content, products, and Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, completeness, availability, security, or accuracy. We do not warrant that the Platform will be uninterrupted or error-free or free of viruses or other harmful components.
17. Limitation of Liability
To the maximum extent permitted by law, the Company, its directors, officers, employees, affiliates, agents, contractors, and licensors shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from or related to your use of (or inability to use) the Platform/Services or Content, including errors/omissions, or any loss/damage incurred as a result of such use.
Monetary cap: The Company’s aggregate liability for any claim shall be limited to ₹1,000 (Rupees One Thousand) or the order value, whichever is lower.
18. Indemnity
You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, affiliates, and agents from and against all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to: (i) your use of the Platform/Services; (ii) your breach of these Terms; (iii) your violation of third-party rights; or (iv) your breach of applicable laws. This obligation survives termination.

20. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, the courts at Aurangabad, Maharashtra shall have exclusive jurisdiction over disputes arising from or relating to these Terms or your use of the Platform.
21. Severability
If any provision of these Terms is held invalid, void, or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
22. Changes
The Company may update, revise, supplement, or otherwise modify these Terms and impose new or additional rules or conditions for use of the Platform/Services from time to time. Whenever we make a change, the revised Terms will be uploaded on our website. Your continued use of the Platform after such posting constitutes acceptance of the revised Terms.
23. Survival
Your representations and warranties and the provisions relating to indemnity, limitation of liability, governing law and jurisdiction, intellectual property, and confidentiality (if any) shall survive termination or expiry of these Terms.
24. Entire Agreement
These Terms, together with the Policies referenced herein (including the Privacy Policy and Cancellations/Returns policy), constitute the entire agreement between you and the Company with respect to the subject matter and supersede prior understandings.
